§ 13-75. Definition of "aboveground storage tank."

  • For the purposes of this article, "aboveground storage tank" is defined as any tank that is not buried in the ground and whose primary purpose is that of storage and meets at least one (1) of the following criteria:

    (a)

    Any storage tank that is fixed in place with a capacity of more than six hundred sixty (660) U.S. gallons.

    (b)

    Any portable tank, meaning any packaging (except a cylinder having a one-thousand-pound or less water capacity) over one hundred ten (110) U.S. gallons capacity and designed primarily to be loaded into or on or temporarily attached to a transport vehicle or ship, and equipped with skids, mounting or accessories to facilitate handling of the tank by mechanical means. It does not include any cargo tank, tank car tank, tank of the DOT 106A or 110A type, or trailers carrying 3AX, 3AAX, or 3T cylinders. (See CFR 49 section 171.8).
