§ 13-78. Containment structures required; exceptions.

  • (a)

    The owners or their duly authorized representative of aboveground tank storage in which any liquid substance defined hereinafter is stored are required to construct containment structures around said tanks and shall annually inspect and certify to the department of emergency management that the containment structures are in good condition, are compatible with the liquid stored, and in compliance with specifications outlined in the National Fire Protection Association (National Fire Codes, 1985) pamphlet 30 Sections 2-2.3.2, "Remote Impounding," and/or 2-2.3.3, "Impounding Around Tanks by Diking."

    (b)

    If the facility in which aboveground tank storage is used and in which liquid substances other than class I, II, or III A liquids (as outlined in the N.F.P.A. National Fire Codes, 1985) are stored is permitted by the Louisiana Department of Environmental Quality under the Louisiana Water Discharge Permit System (LWDPS), the Provisions of subsection (a) shall not apply to tanks in process areas, provided that the drainage is routed via an LWDPS treatment train to a permitted LWDPS outfall. However, the owners and operators shall supply a current copy of the LWDPS permit to the department of emergency management.
