§ 13-85. Amount of service charge.

  • (a)

    The service charge shall be based upon the maximum quantity* of a hazardous material used, stored, transported, manufactured, generated, or sold at any one (1) time during the preceding year and as shown in the following table:

    $1,500.00 10,000 and over

     

    * As reflected on Tier II chemical inventory reports from covered facilities.

    (b)

    All service charges defined in Chapter 13, Article VII will be adjusted annually beginning January 1, 2014 and thereafter every January 1st based on the percentage change in the Consumer Price Index. The annual adjustment to these charges will equal a U.S. City Average 12-month Percent Change in the All Urban Consumers—All Items Index (CPI-U) as compiled by the Bureau of Labor Statistics, not to exceed five (5) percent. The actual hazardous materials emergency preparedness service charge in effect for any given year will be published in the Official Journal of Jefferson Parish and in the Progressive Jefferson, the publication ordinarily accompanying water bills, and with the hazardous materials emergency preparedness service charge bills themselves.

    In no event shall the maximum fee exceed one thousand five hundred dollars ($1,500.00) per facility for year 2013. Thereafter, the maximum fee shall equal the sum of one thousand five hundred dollars ($1,500.00) plus the CPI adjustment for each succeeding year.
