§ 16-42. Exemption for certain apartment complexes.

  • (a)

    Those apartment complexes with five (5) or more units at a single location which do not or cannot use the garbage and trash collection services provided by the parish are hereby exempt from the payment of the monthly garbage service charge under the following conditions:

    (1)

    The owner or his agent provides the director of environmental affairs with: 1) a current contract for private waste service at that location; and 2; the owner/agent can document that a current permit has been issued by the department of inspection and code enforcement for the placement of a dumpster on the property;

    (2)

    The director of said department shall investigate each affidavit requesting the exemption and, if all conditions are met, shall approve the request;

    (3)

    The monthly garbage service charge shall be eliminated from the parish utility bill of the apartment complex after the date of final approval of the exemption request.

    (b)

    Reimbursement of the garbage service charge can be retroactive up to one thousand dollars ($1,000.00) or thirty-six (36) months of service fees, whichever is less.

    (c)

    Reimbursement of the garbage service charge can be retroactive up to ten (10) years at the discretion of the director of said department, when it can be proven that the parish was in error.
