§ 16-58. Proximity to residential property regulated; exemption; applicability to existing incinerators.

(a)

No person shall install, locate, construct or operate an incineration device at a distance of less than three hundred (300) feet from a parcel of residential property zoned R-1 and R-2 (as per the parish zoning code). Pathological incinerators are excepted from the provision of this section.

(b)

Incinerators or incineration devices in operation on May 13, 1976 and not meeting the provisions of subsection (a) may be operated provided all other sections of this article are continuously adhered to. If the permit provided for in section 16-65 is revoked for noncompliance, subsection (a) will be in force.
