§ 19-12. Failure of owner to pay assessment; council to collect costs, interest and fees.

If the owner of the railroad right-of-way fails to pay the amount due under the local or special assessment ordinance within thirty (30) days from the date of publication of such ordinance after its final adoption, the council may authorize an action either in rem against the immovable property or in personam against the owner, or both, for the collection of the total amount due, including interest, plus an additional sum equivalent to twenty-five (25) percent of the principal and interest due as attorney's fees.
