§ 20-34. Non-governmental agencies raising funds for parish operations or occupying parish facilities.

  • (a)

    No person shall solicit funds from any third party or otherwise solicit or raise funds from the general public with the representation that the proceeds of such solicitation or donation will benefit or be used for the operation, construction, or maintenance of any facility owned or leased by the Parish of Jefferson or to defray the expense of any function or operation of the Parish of Jefferson, unless such person executes a cooperative endeavor agreement with the parish. No such agreement shall be executed by any parish representative until the term and conditions have been reviewed and approved by the parish attorney.

    (b)

    No person shall occupy any facility, building, or property owned or leased by the parish without first executing a lease with the Parish of Jefferson, which lease shall set forth the terms and conditions of said occupancy. No such lease shall be executed by any parish representative until the terms and conditions have been reviewed and approved by the parish attorney.

    (c)

    No person shall construct any improvements on property owned or leased by the Parish of Jefferson without first obtaining written permission from the Jefferson Parish Council.

    (d)

    If an agreement is executed, in accordance with the provisions of this section, such agreement shall, at a minimum, require that the solicitor give regular accounting to the parish of the revenues received, and shall provide for the terms and conditions of when the proceeds of such solicitations or donations shall be furnished to the parish for the operation, construction, maintenance, or expense of project, property or facility for which the funds were raised.

    (e)

    Nothing herein or in any agreement authorized by this section shall be construed so as to require any non-profit organization, with a tax exempt status under the Internal Revenue Code, to take any action which would result in such organization's loss of such tax exempt status.

    (f)

    Except as otherwise provided in this section, it shall be unlawful for any person to solicit from any third party or the general public or otherwise represent that any solicitation of funds are (i) for the operation, construction, or maintenance of any facility owned or leased by the Parish of Jefferson or (ii) to be used to defray the expense of any function or operation of the Parish of Jefferson. It shall be unlawful for any person to otherwise engage in any unfair or deceptive practices or misrepresentations regarding the purposes for which funds are being solicited.

    (g)

    As used in this section, the following terms shall have the following meanings in addition to any generally accepted meaning:

    (1)

    Parish of Jefferson shall mean any parish operation, department, agency, or project and any special district governed by the Jefferson Parish Council.

    (2)

    Person shall mean any non-governmental corporation, group, agency, person or other entity.

    (3)

    Solicit or solicitation shall mean requesting donations or engage in any charitable fund raising activity.
