§ 20-134. Exceptions.

  • Nothing in this division shall be held to apply:

    (1)

    Signaling devices. To the possession or use of signaling devices for current daily consumption by railroads, trucks or vessels requiring them.

    (2)

    Authorized display. To pyrotechnic displays of fireworks in public parks or other open places where a permit for such display has been issued by the fire department, but before such permits are issued by the fire department, said department shall have determined that provisions have been made for the proper safeguarding of life and property, and it shall further provide that proper fire protection is provided in connection with any such display. "Fire department," as used in this section, means the appropriate fire protection service organization which has jurisdiction over the location of the pyrotechnic display, to-wit, the East Bank Consolidated Special Service Fire Protection District, Fire Protection District Numbers 3, 4, 5, 6, 7, 8, and 9, and any volunteer fire department having a contract with any of the said districts.

    (3)

    Photographic supplies. To the possession, sale or use of normal stacks of flashlight compositions by photographers or dealers in photographic supplies.

    (4)

    Distributors and jobbers. Distributors and/or jobbers of fireworks, as defined by the provisions of, and licensed under, Act 63 of 1958, Regular Session of the Louisiana Legislature may store authorized fireworks for agricultural purposes for sale in or beyond the borders of the parish, provided that the provisions of R.S. 51:657 shall be complied with.

    (5)

    Industrial and construction handling. To the loading, unloading, handling and transportation of any explosive materials, including ammonium nitrate for industrial or construction use provided a permit for such loading, unloading, handling and/or transportation is first obtained from the department of inspection and code enforcement. In the case where these materials are being transported within the parish, the party so transporting is required to receive an authorized route and escort from the sheriffs office.

    (6)

    Storage. To storage of authorized fireworks for sale and delivery beyond the borders of the parish, and the storage of authorized fireworks for sale and delivery in interstate commerce; provided that no fireworks sold under the provisions of this subsection shall be delivered by the distributor and/or jobber, and any distributors or jobbers making any such delivery shall automatically forfeit the privilege of storing fireworks within the parish for any purpose.
