§ 22-76. Definitions.

  • Mobile catering vehicle means a motor vehicle, including trailers, that dispenses food, foodstuffs, seafood of any kind, or beverages, whether refrigerated or unrefrigerated, including potentially hazardous food, that requires cooking, heating or other like preparation by the vendor, either within the vehicle or within twelve (12) hours before the sale.

    Mobile food dispensing vehicle means a motor vehicle, including trailers, that dispenses food, foodstuffs, seafood of any kind, or beverages, whether refrigerated or unrefrigerated, and including potentially hazardous food, that are processed and prepackaged by a manufacturer other than the vender and that does not require any cooking, heating or other like preparation by the vendor, either within the vehicle or within twelve (12) hours before the sale.

    Potentially hazardous food means any food that consists in whole or in part of milk products, eggs, meats, poultry, fish, shellfish, edible crustacea, or other ingredients, including synthetic ingredients, which are easily susceptible to contamination, spoilage, adulteration, or otherwise may be injurious to health of humans or animals, or any such food similarly classified by the state division of health.

    Prepackaged means food, food product, or beverage packaged and sealed in a sanitary container at a duly licensed and approved permanent food or beverage processing facility other than the vehicle or depot, and packaged and stored in a manner approved by the state division of health.
