§ 23-16. Local authority for setting hours and benefits.

  • (a)

    Policy of uniformity. The parish declares that it is the policy of this parish that there be certain uniformity in hours of work per week, sick leave benefits and other benefits of certain classes of employees of the parish, its departments, agencies and special districts.

    (b)

    Authority to set hours of work. The parish reserves unto itself the right to determine the hours of work per day, per week and per month of employees of the parish, its departments, agencies and special districts.

    (c)

    Authority to set benefits. The parish reserves the right to determine the sick leave benefits, vacation benefits, pension benefits of employees of the parish, its departments, agencies and special districts and shall be set such by ordinance.

    (d)

    Overtime limited; employees under authority of parish president. Overtime work is work in addition to the established hours of work per week, and shall be kept to a minimum: Unless otherwise provided by ordinance, the hours of work per day, per week and per month for employees under the supervisory authority of the parish president shall be determined and set by the administrative policy. The parish president shall cause a written statement and explanation for all overtime work performed by such employees along with the compensation paid or payable to each employee for the overtime work to be submitted to the ethics and compliance and audit committee on no less than a quarterly basis. The committee shall receive and review such statements and deliver them to be archived by the parish clerk with or without the addition of the committee's recommendations to the parish administration regarding overtime policies and uses. Nothing in this section shall be interpreted or implemented so as to cause the parish to be in violation of the provisions of the Federal Fair Labor Standards Act or of any other applicable federal or state labor laws or regulations.

    (e)

    Amendments and re-enactments. Hereafter, any amendment or reenactment of this section of the Code or any change in administrative policy shall relate back to the date this section originally took effect.
