§ 23-117. Members of authorities, boards, commissions and committees.

  • (a)

    General rule. For the purposes of this section "full-time" means employment in which a person normally works or is expected to work at least seven (7) hours per each day of work and at least thirty-five (35) hours per week of work.

    (b)

    Prohibitions. No member of any authority, board, commission or committee appointed by the parish council shall:

    (1)

    Receive compensation or anything of economic value, other than that to which he is duly entitled from the parish for the performance of any activity within the scope of his official responsibilities;

    (2)

    Receive compensation or anything of economic value for any service, the subject matter of which either is devoted substantially to the responsibilities, programs or operations of the member's agency, or draws substantially upon official data or ideas which have not become part of the body of public information;

    (3)

    Participate in any way in any transaction involving the authority, board, commission or committee on which he serves in which he, his mother or father, his spouse, the mother or father of his spouse, his child, or any person of which he is an officer, director, trustee, partner or employee has a substantial personal economic interest which he may be reasonably expected to know;

    (4)

    Receive any compensation from any person for assisting that person in any transaction with the parish agency of which he is a member;

    (5)

    Solicit or receive anything of economic value directly or indirectly, to be used to influence the passage or defeat of any matter to be considered or under consideration by an agency of the parish.

    (c)

    Prohibition on contractual arrangement. Any paid member of an agency created by the parish is hereby prohibited from bidding on, entering into or having a personal economic interest in any public contract, subcontract for public works or the furnishing of any materials or supplies of any kind in connection therewith which is authorized, recommended, supervised and/or monitored by the agency.

    (d)

    Financial disclosure:

    (1)

    Any paid member of a board or commission or legal entity created by the parish who knows or should know that the legal entity has derived any thing of economic value through any other person who has bid on or entered into or is in any way interested in any public contract or subcontract or any other public work coming under the supervision of the board or commission or entity of which he is a member, or has furnished any material or supplies of any kind in connection therewith shall be required to disclose the name of such legal entity and the amount of income derived.

    (2)

    Any paid member of a board or commission or legal entity created by the parish who knows or may be reasonably expected to know that his mother or father, his spouse, the mother or father of his spouse or his child has a substantial personal economic interest in a legal entity which has bid on or entered into or is in any way interested in any public contract or subcontract or any other public work coming under the supervision of the board or commission or entity of which he is a member, or has furnished any material or supplies of any kind in connection therewith shall be required to file a financial disclosure statement. Such disclosure statement shall include the name of the parent, spouse, spouse s parent or child, the name of the legal entity, the nature of the business activity, and the amount of income derived.

    (3)

    The disclosure statements required in this subsection shall be filed each year with the personnel board by February first, and such employees: statements shall be a matter of public record.
