§ 23-245. Optional allowances.

  • (a)

    With the provision that no optional selection shall be effective in case a member beneficiary dies within thirty (30) days after retirement, and that such a member beneficiary shall be considered as an active member at the time of death; until the first payment on account of any of the Parochial Employees' Retirement System of Louisiana during his continued employment by Jefferson Parish. Specifically, but without intending to limit the effects of the preceding sentence, his eligibility for membership in the Employees' Retirement System of Jefferson Parish his and his survivor(s)'s eligibility for all benefits payable by the Employees' Retirement System of Jefferson Parish and the commencement dates and amounts of those benefits shall be determined as if the member had remained a member of the Parochial Employee's Retirement System of Louisiana during his continued employment by Jefferson Parish and any actions taken by him or choices made by him with respect to the other state or state-wide plan, such as participation in a deferred retirement option plan and the choosing of optional benefits, shall be treated as if they had been taken or made in the Parochial Employees' Retirement System of Louisiana.

    (b)

    The board of trustees may, in its discretion, deny the right to become members to any class of employees who are serving on temporary basis or other than per annum basis, or whose compensation is only partly paid by the parish.

    (c)

    Should any member in any period of six (6) consecutive years after becoming a member be absent from service for more than five (5) years; or should he withdraw his accumulated contributions; or should he become a beneficiary or die, he shall thereupon cease to be a member, except as provided in section 23-241(a)(2) of this division.
