§ 27-30. Lafitte Area Wide Sewerage Service Area.
(a)
The Jefferson Parish Council herein defines the Lafitte Area Wide Sewerage Service Area within Consolidated Sewerage District No. 1 of the Parish of Jefferson; said Lafitte Area Wide Sewerage Service Area is herein defined as follows:
Beginning at a point marked "A" on Exhibit No. 1 which point is at the intersection of the extension of the western bank of the Fleming Canal (Van Donne Canal) and the centerline of Bayou Barataria, thence in a southerly direction along the existing levee a distance of approximately 2,900 feet to a point marked "B," thence in a southwesterly direction along the existing levee a distance of approximately 2,695 feet to a point marked "C," thence in a westerly direction along the existing levee a distance of approximately 1,660 feet to a point marked "D", thence in a northwesterly direction along the existing levee a distance of approximately 1,850 feet to a point marked "E," thence in a southwesterly direction along the existing levee a distance of approximately 2,770 feet to a point marked "F," thence in a northwesterly direction along the existing levee a distance of approximately 4,800 feet to a point marked "G," which point is approximately 925 feet south of highway 303, thence in a southwesterly direction a distance of approximately 4,430 feet to a point marked "H," which point is approximately 1,845 feet south of Highway 45, thence in a southwesterly direction to a point marked "J," which marks the junction of the Fisher School levee at the Fleming Canal and which is 1,014 feet east of Highway 45, thence in a southeasterly direction along this levee a distance of 2,600 feet more or less to a point marked "K," which point is located on the southern levee at the Gloria Drive Pump Station, thence in a generally northeasterly direction along the existing levee a distance of approximately 1,400 feet to a point marked "L"; thence in a generally southwesterly direction along the existing levee a distance of 1,640 feet more or less to a point marked "M," thence in a generally southwesterly direction along the existing levee a distance of 1,640 feet more or less to a point marked "N," which point is approximately 360 feet east of Highway 45, thence in a southeasterly direction along the edge of the oak ridge, which ridge is approximately 15,510 feet to a point marked "O" just north of Goose Bayou which point is 360 feet east of Highway 45, thence in an easterly direction a distance of approximately 1,775 feet to a point marked "P," thence in a southerly direction along the existing levee which levee varies a distance of between 2,500 feet and 4,000 feet east of the east shore line of Bayou Barataria a distance of approximately 19,950 feet to a point marked "Q," thence in a westerly and northerly direction along the centerline of Bayou Barataria a distance of approximately 10,895 feet to a point marked "R" said point "R" being at the intersection of the extension of the northern bank of Bayou Rigolettes and the centerline of Bayou Barataria, thence in a generally westerly direction a distance of approximately 1,200 feet to a point marked "S," thence in a northerly direction along the existing levee which levee varies a distance of approximately between 300 feet and 3,300 feet west of the west shore line of Bayou Barataria, a distance of approximately 11,265 feet to a point marked "T," thence along the existing levee around the end of a pipeline canal a distance of approximately 1,850 feet to a point marked "U," thence in a northerly direction along the existing levee, which levee is a distance of approximately 2,025 feet west of the west shore line of Bayou Barataria a distance of approximately 1,850 feet to a point marked "V," thence in a easterly direction along the existing levee, a distance of approximately 550 feet to a point marked "W" thence in a northerly direction along the existing levee, a distance of approximately 1,100 feet to a point marked "X," thence in a westerly direction along the existing levee a distance of approximately 500 feet to a point marked "Y," thence in a northeasterly direction along the existing levee, which levee varies a distance of approximately between 2,215 feet and 550 feet west of the west shore line of Bayou Barataria, a distance of approximately 8,500 feet to a point marked "Z," thence in a westerly direction along the existing levee a distance of approximately 1,850 feet to a point marked "A-A," near the Pailet Canal pump, thence along the existing levee around a branch canal on the north side of the Pailet Canal a distance of approximately 2,585 feet to a point marked "B-B," thence in a northwesterly direction along the existing levee, which levee is approximately 3,325 feet west of the west shore line of Bayou Barataria, a distance of approximately 6,650 feet to a point marked "C-C," thence continuing in a northwesterly direction along the existing levee a distance of approximately 2,770 feet to a point marked "D-D," thence in a northeasterly direction along the existing levee to the extension of the centerline of the Bayou Segnette Waterway and continuing along the centerline of the Bayou Segnette Waterway, in a northerly direction a total distance of approximately 7,600 feet to the intersection with a pipeline canal marked "EE"; thence in a northeasterly direction along the centerline of the pipeline canal a distance of approximately 7,800 feet to a point marked "FF"; thence proceed in a westerly direction a distance of approximately 10,400 feet to the centerline of Bayou des Families to a point marked "GG"; thence proceed along the centerline of Bayou des Families to the intersection of the centerline of Bayou Barataria and the centerline of Bayou des Families to a point and hence to the intersection of the extension of the centerline of Bayou Barataria and the extension of the western bank of the Fleming Canal (Van Donne Canal), said point marked "A" and being the point of beginning.
(b)
That the Jefferson Parish Council herein levies a capital cost user fee for each user utilizing the sewerage system in the amount of five dollars ($5.00) per month for five (5) years beginning with the date of the adoption of this section and imposed upon each residential, commercial, or industrial unit utilizing the sewerage system and situated within Lafitte Area Wide Sewerage Service Area for the purpose of defraying the cost of construction of sewerage collection and treatment facilities and paying other expenses incurred in connection with providing sewerage collection and treatment services to the district, a work of public improvement. After the initial five-year period the rates shall be adjusted as set forth in paragraph (c) below.
(c)
In the event that the anticipated five million dollars ($5,000,000.00) of state funds are not obligated to Jefferson Parish after five (5) years from the date of adoption hereof, the capital cost user fee will increase by an amount to be determined by the following formula:
$5,000,000.00 less the amount received from the state of Louisiana for the Lafitte Area Wide Sewerage Program divided by $5,000,000 and multiplied by $12.00, said increase not to exceed $12.00.
(d)
The capital cost user fee to be collected hereunder shall be deposited in a separate fund to be used solely to pay the cost of constructing a sewerage collection and treatment system in the Lafitte Area Wide Sewerage Service Area or to pay the principal and interest on bonds issued for that purpose.
(e)
The above mentioned service charge shall be collected on the Jefferson Parish Department of Water bills for customers within the Lafitte Area Wide Sewerage Service Area.
(f)
The capital cost user fee will terminate upon retiring all debt issued for these improvements.
