§ 2-935.1. Penalty for false information on required submittals.

  • That the council, by resolution, shall terminate a professional services agreement in the event false or misleading information is given to the parish in the required professional services questionnaire; in the affidavit identifying all subcontractors and persons, excluding full time employees of the firm, who would assist in providing professional services for the project; in the acknowledgment submitted with each invoice that no subcontractors or persons, excluding full time employees of the firm, have been added without prior council approval by resolution; or in any other document or information required by this division. Any and all parties found to be in violation of any of the provisions of this division, including, but not limited to, the person or firm under contract with the parish to provide professional services and any and all subcontractors improperly added to such a contract, shall be disqualified from contracting with the parish to provide professional services for one (1) year after such violation is discovered and shall be assessed a penalty payable to the parish in the amount of five thousand dollars ($5,000.00) assessed as liquidated damages for each such violation.
