§ 2-920.1. Appropriation dependency.

  • (a)

    All contracts entered into by the parish shall contain an annual appropriation dependency requirement to the effect that the renewal and/or continuation of such contract is contingent upon the appropriation of funds to fulfill the requirements of the contract and if the parish fails to appropriate sufficient monies to provide for payments under the contract, the contract shall terminate on the last day of the last fiscal year for which funds were appropriated.

    (b)

    The provisions of this section shall apply to all contracts notwithstanding the fact that an appropriation dependency clause is not specifically set forth in a written agreement.

    (c)

    In the event of any dispute between the parish and any contracting party arising from a termination of a contract under the provisions of this section, the payment of any settlement or damages, pursuant to a final judgment by court of competent jurisdiction, shall not be considered an appropriation for the purpose of effecting a renewal or continuation of the contract.
