§ 33-3.67.6.2. Site design.

  • (a)

    Section 33-6.9, Site design, of this UDC shall apply.

    (b)

    Outdoor seating area . Outdoor seating areas, plazas, or courtyards are permitted at the ground level between the building and property line provided that the area:

    (1)

    Does not interfere with pedestrian access or parking areas;

    (2)

    Is not located in a required yard that abuts a residential district;

    (3)

    If adjoining the public sidewalk:

    a.

    Maintains a distinct delineation between the right-of-way line and the outdoor area through the use of hardscape and architectural elements such as a masonry wall, fence, plants, or bollards. These elements may establish the front or corner side building line if:

    1.

    They are an appropriate height and type, and meet section 33-6.8.3.4, Openings, as determined during site plan review; and

    2.

    The building façade also meets the standards of section 33-6.8.3.4, Openings.

    b.

    A nonresidential use may have its principal entrance oriented to the outdoor seating area if accessible to pedestrians from the adjoining public sidewalk;

    (4)

    Is constructed of a durable outdoor surface;

    (5)

    Shall not be:

    a.

    Wider than fifty (50) linear feet or fifty (50) percent of the development site's width, whichever is less;

    b.

    Set back more than twenty-five (25) feet from the required build-to-line or setback; and

    (6)

    Is accessory to a principal use.

    (c)

    Service bays/drives .

    (1)

    All service bays, loading and unloading areas, and trash receptacle and dumpster areas must be screened by a wood, brick, or masonry fence with a minimum height of seven (7) feet.

    (2)

    Service bays and drives and trash receptacle and dumpster areas shall be oriented in such a way that in the process of loading and unloading, no vehicle will block the passage of other vehicles on the service drive or extend into any other public or private street.
