§ 33-4.20.7. Validity.

  • (a)

    The vesting of a development application assures the applicant that the rules will not be changed for the processing of the subject development application unless the parish council finds that the change in rules is essential to the protection of the public health or safety.

    (b)

    Vested rights for new applications shall be valid until action is taken on the application.

    (c)

    If the application is approved, the vested rights shall be valid as long as the approved application is valid and subsequent actions by the applicant meet established deadlines, are approved by the Parish and do not result in the lapse or revocation of an approval. If the application is denied by the final decision-maker the vested rights shall expire upon the later of the date of denial by the final decision-maker or the failure of an appeal to the final decision, provided that the appeal is made within thirty (30) days of the final decision.
