§ 35.5-10. Rights reserved to the grantor.

  • (a)

    Right to purchase the system. Grantor may, in any lawful manner and upon the payment of fair market value lawfully ascertained, purchase, condemn, acquire, take over and hold the equipment, facilities and plant of the grantee, in whole or in part, through the exercise of its powers of eminent domain. In such event, the actions of the grantor and the grantee shall be governed by state law.

    (b)

    Right to require removal of property. At the expiration or termination of any franchise the grantor shall have the right to require the grantee to remove, at its own expense, all portions of the telecommunications system from the rights-of-way.
