§ 36-1. Definitions.
The following words and phrases, when used in this chapter, shall have the meanings respectively ascribed to them in this section:
Abandoned vehicle means a vehicle that is derelict or inoperable and is left unattended and without permission on public or private property, or a vehicle that has remained illegally or without the consent of the owner or person in control of the property whether public or private property, or a vehicle that may be operable and is left unattended on public or private property bearing verbiage that said vehicle or part is for sale or rent.
Apparent violations are abandoned, inoperable, derelict or junked vehicles that have visible qualities indicating that the vehicle has been neglected. Such apparent violations include but are not limited to vehicles that (a) have more than one (1) flat tire, (b) do not have all tires attached properly, (c) do not have a current/valid brake tag or license plate, (d) display verbiage communicating the vehicle or part of the vehicle is for sale, and/or (e) has visibly missing parts needed to operate.
Boot or booting means the act of placing on a parked vehicle a mechanical device that is designed to be attached to the wheel or tire or other part of such vehicle so as to prohibit its usual manner of movement.
Booting service business or booting service operator means the business by an individual, partnership, corporation, association, firm or other business entity of providing booting service as part of its operations.
Business district means the territory contiguous to and including a highway when within any six hundred (600) feet along such highway there are buildings in use for business or industrial purposes, including but not limited to hotels, banks, or office buildings, railroad stations and public buildings which occupy at least three hundred (300) feet frontage on one (1) side or three hundred (300) feet collectively on both sides of the highway.
Derelict vehicle means any vehicle which does not have lawfully affixed thereto both an unexpired license plate and a current vehicle safety inspection tag.
Inoperable vehicle means any vehicle that can not be lawfully operated on a public road, street or highway or that can not be driven due to mechanical malfunctions. Examples include a flat tire, expired license plate or brake tag, unsecured broken window.
Junked vehicle means any vehicle in a wrecked, rusted, dismantled, partially dismantled, burned, partially burned and/or other inoperative condition, or any abandoned vehicle, the condition of which, causes it to be reduced in value below one-third ( 1/3 ) the NADA book value of a similar vehicle in average operable condition, and/or is so damaged or dismantled as to be a total loss.
Minor repairs means and are limited to the exterior and interior cleaning of the vehicle; replacing of windshield wiper blades; replacing of light bulbs or other signaling devices; replacing of batteries and belts; changing or topping off of fluids, in compliance with section 16-10.2 of the Jefferson Parish Code of Ordinances, which prohibits the dumping of trash, debris, greases and oils into catch basins and drainage culverts; changing of tires, not to include breaking down or repair of tires; and replacement of brake shoes and pads. Minor repairs do not include repairs that require(s):
(1)
The lifting of more than one (1) wheel at a time from the ground;
(2)
A person to go under the automobile or truck to do the work, except in the case where it is necessary to disconnect the drive shaft in order that the vehicle may be towed;
(3)
The dismantling in whole or in part or the removal of the motor, the transmission, the rear end drive, the radiator, the gas tank, or the brake drums; or
(4)
The removal of any of the vehicle body parts.
Park or parking, when prohibited, means the stopping or standing of a vehicle, whether occupied or not, other than while temporarily stopped for the purpose of and while actually engaged in the loading or unloading of merchandise or passengers.
Party bus also known as a limo bus, limousine bus, party ride, or luxury bus means a motor vehicle derived from a coach or conventional bus, such as a school bus, that is modified and designed to carry more than ten (10) passengers with amenities that include, but are not limited to, sound systems, laser lights, dance floors or dance poles, for compensation.
Private property means real estate, including all improvements, not owned or controlled by the parish, State of Louisiana or United States of America near or contiguous to: (i) premises having one (1) or more stores or establishments which is used for the parking of vehicles of customers or patrons or any one who frequents such stores and business establishments or (ii) premises having one (1) or more multiple dwellings which is used for the parking of vehicles for the occupants and guests of the residents.
Public right-of-way means any street, avenue, boulevard, highway, sidewalk, alley or similar place normally accessible to the public which is owned or controlled by a governmental entity.
Sidewalk area means that portion of ground between the roadway and the property line of the adjacent landowner.
Stop, when required, means complete cessation of movement.
Stop, stopping or standing, when prohibited, means any stopping, standing or halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a law enforcement officer or traffic control sign, signal or officer.
Street and/or public roadway means every way or place in public ownership used for vehicular traffic, whether paved or not, immediately adjacent to a residence or property classified as R-1A, R-1B, R-1C, R-1D, R-1MH, R-1TH, R-1CO, R-2, RR-3, or R-3 residential property as defined by the comprehensive zoning ordinance.
Total loss means that the cost to repair a damaged or dismantled vehicle exceeds the junk value of such vehicle, as determined by any recognized national appraisal book.
Trailers shall mean any vehicle, covered or uncovered, without motive power, designed for carrying property or passengers, or designed to be used for living, sleeping, business or storage purposes, having no foundation other than wheels, blocks, skids, jacks, horses or skirting and which has been or reasonably may be equipped with wheels or other devices for transportation from place to place, whether drawn or towed by a motor vehicle or other motive power or other means, or is otherwise subject to the provisions of Louisiana Revised Statutes, Title 32 Motor Vehicles and Traffic Regulations.
Valet parking operation means any organized program or system, which provides for the parking of vehicles operated by the patrons of any business establishment by persons other than the owner, operator or occupant of the vehicle.
Vehicle owner or motorist means the actual owner of the vehicle booted or any driver of the vehicle who reasonably appears to have authority to operate the vehicle.
Vehicle means any object used for transport, whether or not self-propelled and/or, subject to state registration, or an object which is moved or pulled by its being attached to an object used for transport, such as a boat, trailer, hauler or camper. A vehicle may include bicycles, cars, motorcycles, trains, watercraft, or aircraft.
