§ 36-70. Gross weight limitation of vehicles; exceptions.

  • (a)

    No person shall operate any commercial vehicle exceeding ten thousand (10,000) pounds gross weight, including load, on any street in the parish which is under the care, control and maintenance of the parish except those streets designated as truck routes in section 36-71; except that vehicles in excess of ten thousand (10,000) pounds gross weight, including load, may be operated on such streets for the purpose of delivering materials or merchandise and then only by entering such street at the intersection nearest the destination, proceeding thereon by the most direct route to the vehicle's destination and exiting by the same route; and further excepting that no articulated tractor-trailer type vehicle may make such deliveries to or from any commercial establishment, including but not limited to any commercial establishment operating as a nonconforming use in an area zoned residential.

    (b)

    Weight limit signs shall not be required for the enforcement of this section on those streets under the care, control and maintenance of the parish which are not designated as part of the parish truck route system in section 36-71.

    (c)

    That the prohibitions in paragraph (a) of this section shall not apply to fire and emergency vehicles, commercial garbage, refuse, or trash removal vehicles, including waste removal vehicles, public and private utility vehicles (including electric, gas, telephone, and cable television vehicles), or any other like vehicle.

    (d)

    Prohibitions in paragraph (a) shall not be applicable to streets that are designated as "local deliveries only" zones, which are designated as follows:

    (1)

    Bonnabel Boulevard—Deliveries to all businesses between 1409 Metairie Road and 2055 Metairie Road;

    (2)

    Massachusetts Avenue, between the intersections of Massachusetts Avenue and Veterans Boulevard and Massachusetts Avenue and 26th Street; 26th Street from its intersection with Massachusetts Avenue and the Kenner City boundary;

    (3)

    York Avenue from Gretna Boulevard in a northerly direction for the depth of Lot 20-A-1, Square 27, South New Orleans Subdivision, an approximate distance of three hundred fifty (350) feet from the intersection of York Avenue and Gretna Boulevard.

    (4)

    Coolidge Street, between Jefferson Highway on the south and the railroad right-of-way on the north; Harding Street, between Jefferson Highway and Spruce Street; Spruce Street, between Coolidge Street and Harding Street.

    (e)

    The Jefferson Parish Council shall have the right to designate any streets in the Parish of Jefferson as "local deliveries only" zones.

    (f)

    A sign stating "No Truck Route - Local Deliveries Only, J.P. Ordinance No. 19014 shall be posted on each newly designated route.
