§ 36-72. Operating vehicles on levees.

  • (a)

    Generally. It shall be unlawful for any person to park, store, drive or ride any motor vehicle which exceeds one thousand (1,000) pounds in weight upon the levees of the Mississippi River on the west bank of the parish.

    (b)

    Removal by parish. Any motor vehicle exceeding one thousand (1,000) pounds in weight found parked or stored upon the levees of the Mississippi River on the west bank of the parish shall be removed from the levee by authorized personnel of the sheriffs department and stored on parish property designated by the director of inspection and code enforcement as an automobile pound.

    (c)

    Court designated. Violators of this section whose motor vehicle has been impounded shall be notified by the sheriffs department to answer before the Twenty-fourth Judicial District Court.

    (d)

    Violations of section 36-143. The parish council shall provide suitable serially numbered forms in triplicate for notifying violators to appear in answer to charges of violating section 36-143, such forms to be given to the sheriffs department, which shall make the notifications.

    (e)

    Fees. Impounded vehicles will be surrendered to duly identified owners upon the payment of seven dollars and fifty cents ($7.50) towing fee, plus one dollar ($1.00) per day storage fee. The funds so collected shall be deposited in the sheriffs salary fund.

    (f)

    Disposition of unclaimed vehicles. Vehicles remaining unclaimed ten (10) days after proper notification of one (1) of the registered owners or sixty (60) days after the vehicle is impounded, if the owner or owners are unknown, shall be sold by the sheriffs department after advertising in the parish journal three (3) times within thirty (30) days, and the net proceeds after the payment of advertising cost and sheriffs cost and fees, shall be paid into the parish general fund.

    (g)

    Exceptions. The provisions of this section shall not apply to those persons who are members of the Lafourche Levee District and are employees of the district and to those persons who have received written permission from said levee district to make use of said levee as herein set forth.
