§ 36-321. Succession of events.

  • (a)

    When the citation is issued pursuant to this article for an alleged violation, the vehicle owner is the person responsible for the payment of the fine and any other penalties, as applicable. There shall be a rebuttable presumption that the person to whom the vehicle is registered was the operator of the vehicle at the time the alleged violation was committed. Additionally, any operator of a vehicle who is not the vehicle owner, but who uses or operates the vehicle with the express or implied permission of the owner shall be considered the agent of the owner to receive the violation required to be sent to the vehicle owner. When the vehicle owner appears to have violated the provisions of this Article, he/she will be issued a notice of violation that will include the evidence of the violation as well as other information and documents as outlined hereinbelow in section 36-324. Before the notice is sent to the vehicle owner, the evidence shall be reviewed by the Jefferson Parish Sheriff's Office to ensure that the violation is accurately recorded and witnessed.

    (b)

    The vehicle owner will have thirty (30) days to respond to the violation notice by either paying the fine or contesting the fine.

    (c)

    Failure to perform by either paying the fine or contesting the fine will result in an additional twenty-five dollars ($25.00) late fee. If the civil and late fees are not paid within fifteen (15) days of receiving the second notice, the matter will be submitted to the district attorney for prosecution.
