§ 37-1. Trimming of trees or shrubs in residential areas with power equipment prohibited.

(a)

The trimming of trees or shrubs with any "bush hog" -type motorized rotary cutter operated in a vertical position within five hundred (500) feet of any building or structure occupied or capable of habitation is hereby prohibited.

(b)

The trimming of each tree or shrub in violation of the provisions of this section shall constitute a separate offense. Each offense shall be punishable by a fine not exceeding five hundred dollars ($500.00) or imprisonment for a term not exceeding thirty (30) days or by both such fine and imprisonment, within the discretion of the court or hearing officer.
