§ 38-18. Verification and issuance/denial of license.

  • (a)

    Upon receipt of a complete application for the issuance or renewal of a company license, PMZ may verify all information provided in the application for compliance with all applicable provisions of this chapter; and, if the company has met the requirements set forth in this chapter and has timely paid the company license fees set forth in section 38-15 of this chapter, the parish will issue a company license.

    (b)

    If an applicant knowingly provides false statements of material facts or information on the license application, the applicant—in addition to facing any criminal charges—will automatically be denied the company license and will thereafter be ineligible for a company license for a period of five (5) years. If the company license has been issued prior to the discovery of the false statements or information, the company license shall be revoked; and the company will thereafter be ineligible for a company license for a period of five (5) years.

    (c)

    Any applicant that is denied a company license shall be given written reasons for the denial and may, within ten (10) days of receipt of said written reasons, request a hearing before the bureau of administrative adjudication in which to present a defense. In the event the hearing results in an affirmation of the denial of a company license, the applicant may appeal to the Twenty-Fourth Judicial District Court for the Parish of Jefferson for relief from the denial.
