§ 38-34. Sightseeing cars and buses.

  • (a)

    Sightseeing cars and buses must post the rate for each tour offered to the public or provide to prospective riders in advance of the tour an information sheet/folder outlining the points-of-interest to be visited and the cost of the tour.

    (b)

    Sightseeing cars and buses shall not be used for transportation of riders for compensation except on sightseeing tours or chartered trips.

    (c)

    All circulars, leaflets, posters, pamphlets, or any other advertising matter describing any sightseeing trip, tour, or excursion must receive the approval of PMZ prior to display or distribution to the public.

    (d)

    All sightseeing businesses or their agents operating on the streets of unincorporated Jefferson Parish must be approved and regulated by PMZ.

    (e)

    A schedule of rates of fare for each type of trip/tour shall be filed with PMZ for all sightseeing cars and buses.

    (f)

    A schedule of rates charged for each trip/tour shall be conspicuously displayed at the starting point upon a sign attached to the vehicle, as near to the entrance as practicable, during the time riders are entering such sightseeing cars and buses; and such signs and schedules of rates shall remain thereon until such vehicles depart.

    (g)

    No business or any of its agents, operators, sightseeing guides, or lecturers shall charge or attempt to charge any person a sum greater than that set forth in the rate schedule for such sightseeing cars and buses.

    (h)

    All sightseeing businesses and their agents shall, upon request, deliver to all riders, upon payment of fare, a printed receipt indicating: the amount of fare paid, the description or designated number of the trip, and the time scheduled for the sightseeing car/bus to leave the starting point.

    (i)

    All sightseeing cars and buses shall operate on a prescribed route when one is so designated.

    (j)

    All sightseeing business and their agents shall maintain daily records of each trip, tour, and excursion made; and such records shall be available to PMZ at all times, shall be retained for no less than three (3) years, and shall contain the following:

    (1)

    Date and time of the start and termination of the trip, tour, or excursion;

    (2)

    Name of the person(s) who contracted or solicited the riders or who contracted for the specific trip, tour, or excursion;

    (3)

    Name of the person(s) acting as the guide(s) or lecturer(s) during the trip, tour, or excursion;

    (4)

    Vehicle operator's name and authorization/identification number; and

    (5)

    Vehicle's identification number, VIN, chassis number, or state license plate number.

    (k)

    The provisions of this article shall not apply to vehicles exclusively hired/engaged under a contract for a special trip/excursion.

    (l)

    All rules and regulations not inconsistent with this article that are applicable to any VFH company/driver shall also apply to owners/operators of sightseeing vehicles and buses.

    (m)

    No operators/owners of sightseeing cars and buses shall be permitted to park more than one (1) sightseeing vehicle (or other vehicle regulated by this chapter) at the place of residence of any such operator/owner, on the street in the immediate vicinity thereof, or on other private property owned, leased, or rented by the operator/owner, or on other private property under the control of another party unless otherwise permitted under other provisions of this Code or state law.
