§ 40-879. Adoption of amendment, supplement or change.

  • (a)

    The planning director shall submit to the planning advisory board a report of his findings and recommendations as to the proposed change or joint changes for each case on the docket. After review by the planning advisory board, the planning director shall submit to the council his recommendations and those of the board as to the proposed change or joint changes for each case on the docket of the planning advisory board. The council shall not take official action until the report of the planning director and the board are received, provided, however, that if such report has not been filed within forty-five (45) days after the date of the public hearing, the council may then take official action upon the change or amendment.

    (b)

    For consideration of joint changes proposed to the official zoning map and the future land use map to maintain consistency in accordance with this chapter, the council shall take a final yea or nay vote on the proposed joint changes as a whole.

    (c)

    No amendment, supplement or change to the comprehensive zoning ordinance, future land use map, or district map shall become effective unless and until:

    (1)

    There has been a public hearing as provided above, and

    (2)

    The council shall take a final yea or nay vote on the proposed change or joint changes within one hundred twenty-six (126) calendar days from the date of the public hearing, however, in the event that the one hundred twenty-six (126) calendar day deadline falls on a holiday or a meeting that has been cancelled by the council, the one hundred twenty-six (126) calendar day deadline will be extended automatically to the next regular council meeting.
