§ 6-86. Insurance.

  • (a)

    Each parade organization shall maintain at its expense general liability insurance in the amount of one million dollars ($1,000,000.00) per occurrence for bodily injury and property damage with a three million dollar ($3,000,000.00) aggregate and auto liability insurance, combined single limit of three million dollars ($3,000,000.00) or equivalent. A parade organization may, at its expense, opt to purchase a special event insurance policy appropriately endorsed to provide the required coverage. The "Parish of Jefferson, its districts, departments and agencies under the direction of the parish president and the parish council" shall be named as an additional insured to the liability policy issued to each float or truck parade organization. A parade permit shall not be, issued without receipt from the insurer or its agent of record of a bona fide certificate of insurance, which indicates that the "Parish of Jefferson, its districts, departments and agencies under the direction of the parish president and the parish council" are additional insureds. As additional insureds, the Parish of Jefferson, its districts, departments and agencies under the direction of the parish president and the parish council shall be afforded coverage to the same extent as the named insured.

    (b)

    Each insurance company providing the specified coverage shall have an A.M. Best "B" rating or higher.

    (c)

    To the fullest extent permitted by law, each parade organization agrees to protect, defend, indemnify, and save the parish, its agents, officials, employees, servants, including volunteers, or any firm, company, organization, or individual, or their contractors or sub-contractors with whom the parish may be contracted, harmless from and against any and all claims, demands, loss or destruction of property, actions, and causes of action of every kind and character, including but not limited to claims based on negligence, strict liability, and absolute liability which may arise in favor of any person or persons on account of illness, disease, loss of property, services, death or personal injuries resulting from any parade activity by the organization, regardless whether others may be wholly, concurrently, partially, or solely negligent, or strictly liable, or absolutely liable or otherwise at fault, and regardless of any defect in the premises, equipment, or materials, irrespective of whether same pre-existed this agreement, except damages arising out of injuries or property claims by third parties caused by the sole, wanton or intentional negligence of the parish, its employees or agents.

    (d)

    Each vehicle in a parade shall be properly insured.

    (e)

    The certificate of insurance described in subsection (a) must be submitted to the department of citizens' affairs no later than thirty (30) days prior to the start of the Carnival/Mardi Gras parade season.
