§ 6-101. Outdoor concessions during Carnival Parade Season.
(a)
Any property owner or business owner or lessee may apply to operate an outdoor concession during the Carnival Parade Season provided they have the proper facilities which pass inspection by the department of inspection and code enforcement and, if required, by the State Department of Health. Also, any property owner or business owner or lessee may apply to operate an outdoor concession during the Carnival Parade Season, provided they have the proper facilities which pass inspection by a Jefferson Parish Fire Department. The director of the department of inspection and code enforcement is hereby granted full authority to make inspections and to pass upon each place as to whether they meet the requirements or not, and is hereby given authority to close any business that does not comply.
(b)
All applications for such outdoor concessions during the Carnival Parade Season shall be made at least twenty-one (21) days prior to the start of the official Carnival Parade Season to allow the office ample time to obtain necessary resolutions from the parish council authorizing such stands. Any stands constructed and doing business without council approval, permits and licenses shall be deemed inoperable by the appropriate authorities.
(c)
It shall be a requisition that the department of inspection and code enforcement and a Jefferson Parish Fire Department inspect all food and beverage stands to ascertain if they meet code regulations, and, if required, by the state department of health.
(d)
The following requirements shall be adhered to:
(1)
All concession stands must be approved by council resolution;
(2)
No concession stand is to be located on public property without specific approval of the Jefferson Parish Council;
(3)
A department of inspection and code enforcement peddler's permit is required for all concessions stands;
(4)
No open flame heating or cooking systems shall be permitted;
(5)
Vendors are prohibited from selling "silly string(s)". For the purposes of this section, "silly string(s)," regardless of its brand name, shall be defined as an item when used emits a string-like or streamer-like substance that is shot or expelled from a pressurized container;
(6)
Vendors are prohibited from selling "stink bomb(s)" or "stink spray(s)". For the purposes of this section, a "stink bomb" or "stink spray," regardless of its actual brand name, shall be defined as a device for the purpose of emitting an odorous substance when used;
(7)
Vendors are prohibited from selling "bomb bag(s)". For the purposes of this section a "bomb bag" regardless of its brand name, shall be defined as an item when used makes an explosion;
(8)
Vendors are prohibited from selling "laser pointer(s)". For the purposes of this section a "laser pointer" is a device that emits a highly amplified ultraviolet or infrared light;
(9)
Vendors are prohibited from selling "confetti canisters" or metallic confetti streamers or strands. For the purposes of this section, a "confetti canister," regardless of its brand name, shall be defined as an item which contains metallic confetti streamers or other metallic string-like substance that is expelled or discharged under pressure into the air;
(10)
Vendors are prohibited from selling any toy, look-alike, or imitation firearm unless said toy or imitation firearm complies with 15 U.S.C.A. Section 5001(1) and has as an integral part, permanently affixed, a blaze orange plug inserted in the barrel of such toy, look-alike, or imitation firearm. Such plug shall be recessed no more than six (6) millimeters from the muzzle end of the barrel of such firearm. For the purposes of this section a "imitation firearm" regardless of its brand name shall mean any imitation of any original firearm which was manufactured, designed, and produced since 1898, including and limited to toy guns, water guns, replica nonguns, and air-soft guns firing nonmetallic projectiles. Any law enforcement authority is authorized to immediately seize and confiscate any toy, look-alike, or imitation firearm that does not conform with the provisions of this section;
(11)
Vendors are not allowed to have outdoor music (live or amplified) or have outdoor entertainment;
(12)
Vendors are prohibited from using generators;
(13)
Vendors are allowed to operate only up to one (1) hour after the parade passes.
