§ 8.5-1. Definitions.

  • For purposes of this chapter, the following terms have the respective meanings ascribed to them in this section, unless a different meaning clearly applies from the context:

    Act shall mean the Communications Act of 1934, as amended (and specifically as amended by the Cable Television Consumer Protection and Competition Act of 1992, Pub. L. 102-385), and as may be amended from time to time.

    Associated equipment shall mean all equipment and services subject to regulation pursuant to 47 C.F.R. 76.923.

    Basic cable service shall mean "basic service" as defined by the FCC Rules, and any other cable television service which is subject to rate regulation by the parish pursuant to the Act and the FCC Rules.

    FCC shall mean the Federal Communications Commission.

    FCC Rules shall mean the rules and regulations of the FCC, 47 C.F.R., promulgated from time to time pursuant to the Act.

    Franchisee and cable operator shall refer to any entity holding a franchise from the Parish of Jefferson or otherwise authorized to deliver cable television signals in Jefferson Parish. To the extent not inconsistent with this and other ordinances of Jefferson Parish, all other words and phrases used in this article shall have the same meaning, if any, as defined in the Act and FCC Rules.

    Increase in rates shall mean any increase in rates, a decrease in programming or customer services or the reduction in number or quality of television channels carried in the basic cable services.

    Parish shall mean the Parish of Jefferson.
