Article VII. HAZARDOUS MATERIALS EMERGENCY PREPAREDNESS SERVICE CHARGE |
§ 13-87.1. Self fueling facilities.
Those industries, corporations and/or facilities which meet the following criteria are to pay a fee of sixty dollars (60.00) per fuel dispensing unit.
• Limited to storage of liquid fuel materials used in the operations of vehicles and/or equipment in an amount not to exceed twenty thousand (20,000) gallons.
• No on-site storage of an EHS (extremely hazardous substance*) materials, and
• Any other regulated hazardous materials present on the facility must be in transportation and under active shipping papers.
Those industries, corporations and/or facilities which have in addition to liquid fuel materials in an amount not to exceed twenty thousand (20,000) gallons gasoline, such materials as motor oil, brake fluid, hydraulic fluid, or any other substances used for the maintenance of their vehicles and/or equipment (limited to engine and drivetrain, only) shall pay a fee of sixty dollars ($60.00) per fuel dispensing unit plus one hundred fifty dollars ($150.00).
* Extremely hazardous substance is defined in 40 CFR 355, Appendix A.
