§ 17-104. Adequate ventilation.

  • (a)

    Whenever an employer or other business establishment designates a room or other enclosed area as a smoking area in accordance with the provisions of these regulations, such smoking area shall have:

    (1)

    Solid walls and ceiling and a closable door;

    (2)

    Walls tightly joining floor and ceiling;

    (3)

    Opening to adjacent nonsmoking areas limited to make-up air inlets;

    (4)

    A mechanical exhaust system that exhausts directly to the outside without recirculation to nonsmoking areas by providing a negative pressure sufficient to prevent smoke migration to enclosed nonsmoking areas. The volume of air per minute removed by every such exhaust system shall at the very least equal the volume or air per minute entering into the smoking area.

    (b)

    Whenever a portion of a public area is designated as a smoking area in accordance with the provisions of these regulations, such smoking area shall have either:

    (1)

    A mechanical exhaust system that exhausts directly to the outside without recirculation to nonsmoking areas by providing a negative pressure sufficient to prevent smoke migration to adjoining nonsmoking areas, or

    (2)

    A mechanical air filtration system, certified by a Louisiana architect or a Louisiana registered professional engineer, as being sufficient to prevent migration or recirculation of smoke into nonsmoking areas.

    (c)

    The provisions of this section shall apply to all new construction and to any existing premises when a building permit is issued for any work other than maintenance.
