§ 20-103. Possession of open alcoholic beverages in certain locations.

  • (a)

    It shall be unlawful for any person to possess an open alcoholic beverage container, or to consume an alcoholic beverage, on the premises of any commercial retail establishment that does not possess an alcoholic beverage license that permits consumption on the premises.

    (b)

    It shall be unlawful for any person to possess an open alcoholic beverage container, or to consume an alcoholic beverage, on public property or on private property not owned or leased by said person within five hundred (500) feet of the premises of any commercial retail establishment from which the beverage was purchased if such establishment does not possess an alcoholic beverage license that permits consumption on the premises.

    (c)

    Any person who violates the provisions of this section shall be punished as set forth in section 1-10.
