Article VI. SOLICITATIONS FOR LAW ENFORCEMENT AGENCIES |
§ 22-143. Definitions.
The following definitions shall govern in the use and interpretation of this article unless the context clearly indicates otherwise:
Law enforcement agency shall mean any state, parish, municipal, or local governmental agency, department or office with law enforcement authority; it shall also mean any non-profit corporation, organization, association, fraternity or other such entity created by or for the benefit of law enforcement officers.
Solicit funds for or on behalf of shall mean the selling or any item, property, article or anything of value or the request, directly or indirectly, for contributions or money, credit, property, financial assistance, or anything of value, from any person in which it is stated suggested, implied or otherwise intimidated that all or any portion of the proceeds of the solicitation will or may be used by or for the benefit of any law enforcement agency or any law enforcement officer. The words shall also mean and include any method of request or selling, whether oral or written.
Solicitor means any person who, for financial consideration, solicits funds for or on behalf of a law enforcement agency, whether such solicitation is performed personally or through his agents, servants, or employees or through agents engaged in the solicitation of contributions under the direction of such person. It shall also mean any salaries corporate officer or salaries employee of a non-profit organization who solicits funds for such organization. This definition shall not apply to a person who solicits contributions on behalf of a law enforcement agency on a voluntary basis and receives no remuneration for his services. Persons making intrastate solicitations from Louisiana or making interstate solicitations into Louisiana for charitable organizations are deemed to be solicitors for the purposes of this article.
