§ 23-109. Standards.

  • (a)

    Economic interests of a public employee. No public employee shall participate in a transaction involving the parish in which he has a personal substantial economic interest which he may reasonably be expected to know.

    (b)

    Economic interest of persons in which a public employee has an interest. No public employee shall participate in a transaction involving the parish in which, to his actual knowledge, any of the following persons have a substantial economic interest:

    (1)

    His spouse or child;

    (2)

    His mother or father or the mother or father of his spouse;

    (3)

    Any person in which he has an economic interest of which he may reasonably be expected to know;

    (4)

    Any person of which he is an officer, director, trustee, partner or employee;

    (5)

    Any person with whom he is negotiating or has an arrangement concerning prospective employment; or

    (6)

    Any person who is a party to an existing contract with such employee or obligee of such employee as to a thing of economic value and who, by reason thereof, is in a position to affect directly such employee's economic interests.

    (c)

    Disqualification. Every public employee shall disqualify himself from participating in a transaction involving the parish when such participation would result in a violation of the provisions of this division.

    (d)

    Permitted exceptions. Nothing in this section shall prevent a public employee from:

    (1)

    Sharing in any compensation received from the parish by a person of which such employee owns or controls less than ten (10) percent, provided such employee did not assist in the procurement of such compensation;

    (2)

    Sharing in any compensation received from the parish entity by a person of which such employee owns or controls any portion thereof, provided such compensation was received by such person as a result of having made the lowest sealed competitive bid on a public contract or subcontract and having had such bid accepted by the parish or the general contractor, and provided such employee did not assist in the procurement of the acceptance of such low bid.
