§ 23-136. Rescission of action of governmental entity.

  • (a)

    Subject to the limitations hereinafter set forth, the board may cancel or rescind any contract involving the parish without contractual liability to the parish where:

    (1)

    The board has found that a violation of this division within its jurisdiction has influenced the making of such contract; and

    (2)

    The board finds under all of the circumstances that the interests of the parish so require.

    (b)

    However, such rescission is to be limited so as to not adversely affect the interests of innocent third parties.

    (c)

    The finding referred to in subsection (a)(1) of this section shall be made in accordance with the procedures set forth in the laws of the state and the parish and shall be subject to judicial review in accordance with the provisions of such laws, provided that the board may suspend the contract subject to the limitations in subsection (a)(2) of this section pending the determination of the merits of the controversy.
