§ 26-3. Requirements for permit.

  • No person shall conduct a fair, exhibition, show, circus performance or event which constitutes an amusement attraction or utilizes an amusement ride as defined in this article without first showing proof of insurance against liability for injury suffered by persons attending the fair, exhibition, show, circus performance or event which utilizes an amusement attraction or amusement ride. In addition the operator of amusement attractions or rides for a fair must show proof of insurance from an insurance company with an A.M. Best Rating of B+ or better in an amount of not less than one million dollars ($1,000,000.00) insuring the operator against liability for injuries suffered by persons riding the amusement attractions or rides. The grounds on which any fair, exhibition, show, circus performance or event which utilizes an amusement attraction or amusement ride is to be held shall be subject to inspection by the department.
