§ 2-35. Council agenda and supplemental agenda.

(a)

All items for inclusion on the agenda shall be submitted to the parish clerk no later than 3:00 p.m. on the Tuesday in the week prior to the week of the council meeting at which the issue is scheduled to be considered, except when the parish clerk designates a different deadline for submittal of proposed ordinances due to holidays or emergency office closures. The agenda shall be posted or otherwise disseminated in accordance with law.

(b)

Notwithstanding the provisions of section 2-35(a) herein, any council member may submit resolutions to the clerk not later than 3:00 p.m. on the Thursday before each council meeting for inclusion on the council agenda addendum for that meeting. The agenda addendum shall be posted on the parish website twenty-four (24) hours prior to the start of the meeting and shall otherwise be advertised in accordance with the procedures set forth in La. R.S. 42:19.

(c)

Resolutions that are not included in either the agenda or the agenda addendum may only be presented for consideration by the council pursuant to the procedure set forth in La. R.S. 42:19 and section 2-34.1(c) of this Code.

(d)

Any amendment to an ordinance which appears on the agenda for final adoption may only be presented for consideration by the council if the amendment has been distributed to all council members in written and/or electronic form on or before 12;00 p.m. (noon) on the day before the date of the meeting at which the ordinance to be amended is to be considered for adoption. For amendments to an ordinance amending the parish's operating or capital budget, the written or electronic amendment must include a description of the amendment, which description shall include the amount of the allocation; the source of the funds for the amendment; the purpose and/or project for which the funds are to be used; and the councilmember or councilmembers requesting the amendment. Notwithstanding this provision, an amendment to an ordinance which has not been distributed to all council members in written and/or electronic form on or before 12;00 p.m. (noon) on the day before the date of the meeting at which the ordinance to be amended is to be considered for adoption may be considered provided that:

(1)

the amendment is read aloud in full by the parish clerk or by the councilmember proposing the amendment prior to the vote on the amendment; which reading, in the case of amendments being offered for the operating or capital budget, shall include the description of the amendment as set forth in section 2-35(d) herein;

(2)

the amendment is considered for adoption and the vote on the amendment is taken separately from the consideration and vote on any amendment which has been distributed to all council members in written and/or electronic form on or before the day before the date of the meeting at which the ordinance to be amended is to be considered for adoption; and

(3)

the amendment is not to be considered unless it receives unanimous support for consideration by all council members present for the vote on the consideration of the amendment.
