§ 2-877.3. Procedure and lease provisions regarding the lease by public bid to wireless communications service providers of property owned by the parish established for the installation of equipment and/or towers related to the wireless transmission of intelligence.
The lease of property owned by the Parish of Jefferson, or any of the special districts or subdistricts within the parish for the installation of equipment and/or towers related to the wireless transmission of intelligence shall be by public bid. Said public bid shall be conducted in accordance with the following provisions:
(1)
Before the lease of any location is put out for public bid, specifications shall have been prepared showing the exact location of each antenna, equipment shelter and/or other equipment. Constructions and/or related installations proposed and also showing the amount of space available for such installations and said specifications must have been approved by the head of the department which manages the property on which such bids are being considered and will become part of the specifications in the bid documents.
(2)
A parish-approved qualified appraiser familiar with the market value of the lease of wireless communications equipment and/or towers sites shall be selected to prepare a written report stating the market value of the lease of said location for the installation of wireless communications antennas and other equipment. Said appraisal shall be no more than six (6) months old or shall be updated in writing by said appraisal no more than six (6) months prior to the date of letting of the public bid.
(3)
The minimum acceptable bid for the lease of said location shall be the market value as determined by and stated in a written report which shall be produced by a parish-approved qualified appraiser familiar with the market value of the lease of wireless communications equipment and/or tower sites. No bid shall be considered that does not equal or exceed said market value.
(4)
The following shall be included in bid documents:
a.
A written legal description of the site with a specific description of the exact location proposed for lease on the site; and
b.
A locator map (similar to that used by the planning department to locate property involved in requests for zoning changes); and
c.
Drawing(s) showing the specific location on the site and/or the location on a structure on the site (whichever is most appropriate) and showing the amount of space available for such installation plus specifications showing the exact location of each antenna, equipment shelter and/or other equipment, constructions and/or related installations proposed; and
d.
A written description of how the land and/or structure is currently used and how it will be used by lessee, including the number and size of the antennas and/or tower to be located on the property; and
e.
The lease provisions specific to the locations and circumstances for the lease to wireless communications service providers of property owned by the Parish of Jefferson, or any of the special districts or subdistricts within the parish for the installation of equipment and/or towers related to the wireless transmission of intelligence; and
f.
Notice of a mandatory pre-bid conference.
(5)
The department of general services and procurement purchasing divisions shall advertise for bids on the lease of said location and shall solicit bids from persons/entities interested in acquiring the lease of said location.
(6)
There shall be a mandatory pre-bid conference; notice of said mandatory pre-bid conference shall be included in the advertisement for bids and in the bidding instructions.
(7)
A resolution authorizing the lease of the property shall fully describe the property and shall state the market value, the name of the proposed purchaser, the amount of the highest bid for the lease and shall be submitted after compliance with the above.
(8)
The lease shall be awarded to the highest responsible bidder whose bid is responsive to the specifications in the public bid documents for the lease of the property in question.
(9)
All costs for appraisals, surveys and advertisements in connection with the lease shall be borne by the bidder to whom the lease is awarded.
(10)
The disclosure requirements of section 2-877.2 of the Code of Ordinances of Jefferson Parish shall apply to said lease.
(11)
When the lease was established pursuant to the requirements of this section and the lessee has made improvements to the lease site, the lease may be extended for additional terms pursuant to the following:
a.
For improvements to the leased premises that exceed ten thousand dollars ($10,000.00) and upon verification that said improvements were actually made, the lease may be extended for an additional ten (10) years.
b.
The lease may be extended an additional ten (10) years for every ten thousand dollars' ($10,000.00) worth of improvements above the initial improvements described in subsection a. up to a total of forty (40) years which shall include all initial and extended and/or option periods. The lessee must provide verification that said improvements were actually made in order for the lease to be extended.
c.
If a lease is extended up to the maximum of forty (40) years, it can then be further extended, in ten (10) year increments, up to the maximum allowable under state law.
d.
Notwithstanding any lease terms to the contrary, every lease under this section shall be evaluated and increased according to the Consumer Price Index for All Urban Consumers (CPI-U) every five (5) years.
