§ 37-24. Notice of damage; repairs and replacement; suit for damages.

  • (a)

    Any person who injures, damages or destroys any tree, or other vegetation or property on public property under the care of the department of parkway, shall promptly notify the department of parkway of such fact and that person shall, within such reasonable time as specified by the department of parkway, repair or replace such damaged tree, other vegetation or property to the satisfaction of the director of that department.

    (b)

    If the person who caused such damage fails or refuses to repair or replace the damaged or destroyed trees or other property within such reasonable time, the director of the department of parkway shall do or cause to be done the necessary repairing or replacement, and the costs of this work shall be recovered from the person responsible for the damage or destruction by a proper action of law. In any such action, "The Guide for Establishing Values of Trees and Other Plants", published by the Council of Trees and Landscape Appraisers, current edition, shall form the basis for establishing any monetary damages due for damage or destruction to the tree.
