§ 38-33. Privacy protections.

  • (a)

    A company, driver, or operator shall not disclose to a third party any personally identifiable information concerning any user or passenger unless:

    (1)

    The company obtains the respective user's or passenger's consent for the release of such information;

    (2)

    The disclosure is necessary to comply with a legal obligation; or

    (3)

    The disclosure is necessary to protect or defend the terms and conditions for use of the service or to investigate violations of such terms and conditions.

    (b)

    The limitation of this section does not apply to the disclosure of aggregated user/passenger data and other information about a user/passenger that is not personally identifiable. Violations of this section shall be grounds for the suspension and/or revocation of a company license. The Parish of Jefferson shall have the right to file suit in a court of competent jurisdiction in the Parish of Jefferson to seek appropriate remedies for any violations of this provision.
