§ 13-37. Fire protection district no. 3.

  • (a)

    Creation. A fire protection district is hereby created within the parish comprising and embracing all of that territory within the following described boundaries:

    Beginning at the intersection of the Mississippi River with the western boundary line of the Village of Harahan; thence along the western boundary line of the Village of Harahan in a northeasterly and northwesterly direction until the extension of the Harahan boundary intersects the eastern line of the City of Kenner; thence in a southwesterly direction along the eastern boundary of Kenner to its intersection with the Mississippi River; thence along the river in a southeasterly direction to the west boundary line of the Village of Harahan, the point of beginning.

    (b)

    Official designation. The fire protection district created in subsection (a) shall be known and designated as "Fire Protection District No. 3 of the Parish of Jefferson, State of Louisiana."

    (c)

    Service charge.

    (1)

    The parish council hereby assesses a monthly special service charge on all persons owning commercial and residential structures, whether occupied or unoccupied, located wholly or partly within Fire Protection District No. 3 of the Parish of Jefferson, State of Louisiana, for the purpose of acquiring, constructing, improving, providing, maintaining or operating such district's fire protection facilities. Each residential or commercial unit and each housing unit within a multiple dwelling structure, shall be considered a separate structure and each mobile home shall be considered a structure. The base charge for the special service charge will be adjusted annually beginning January 1, 2002, based on the percentage change in the Consumer Price Index. The annual adjustment will equal a U.S. City Average 12 month percentage change in the All Urban Consumers—All Items Index (CPI-U) as compiled by the Bureau of Labor Statistics. The CPI adjusted charges are published annually in the Official Journal of Jefferson Parish and in the Progressive Jefferson, the publication ordinarily accompanying the water bills themselves.

    (2)

    The above-mentioned special service charge shall be collected on the same billing of the waterworks of the parish, payable at the offices of the department of water and its authorized collecting agencies.

    (3)

    All accounts shall be considered delinquent if not paid within thirty (30) days after receipt of same. If a delinquent account is not paid within thirty (30) days after receipt of the bill, the parish shall have the right to proceed for the collection of such unpaid charges in a manner provided by law for the collection of a parish claim.
