§ 32-65. Application and requirements for sponsorship of banners.

  • (a)

    Submission requirements and application. All sponsors of banners other than the Parish of Jefferson and sponsors obtained by an entity or entities granted the exclusive right by the Jefferson Parish Council to design, manufacture, install and maintain banners shall meet the following requirements:

    (1)

    Any interested person, individual or entity seeking to sponsor banners in Jefferson Parish must complete and submit an application for same to the Carnival and Special Events Division of the department of citizens' affairs at least thirty (30) days prior to the requested date of the display of the banners;

    (2)

    If the banner is to advertise, inform the public about or depict an upcoming event, all pertinent information pertaining to the event must be provided with the application, including, but not limited to the nature and scope of the event, date(s) of the event, and benefit to Jefferson Parish, including economic benefit to the parish;

    (3)

    A drawing, photograph, or other rendering of the proposed banner, drawn to scale and depicting the actual colors of the banner, must be submitted with the application. The actual size of the banners must be either thirty (30) inches by ninety (90) inches or twenty-four (24) inches by sixty (60) inches;

    (4)

    A non-refundable fee of one hundred dollars ($100.00) shall be submitted to the carnival and special events division of the department of citizens' affairs along with the application. This fee is due and payable when the application is submitted;

    (5)

    In addition to the application fee, the sponsor of the banners must submit to Jefferson Parish with the application a fee of ten dollars ($10.00) per banner per week ($10.00 × number of banners × number of weeks to be displayed). Each period of seven (7) days or portion thereof shall be considered a week for purposes of this section. This fee is due and payable when the application is submitted. The council in its discretion may reduce this fee for non-profit or civic organizations sponsoring banners;

    (6)

    The sponsors of the banners shall assume full responsibility for any claims arising from or related to the banners and the use brackets and shall fully protect, defend, indemnify and shall hold harmless Jefferson Parish and/or any other owner(s) of the light standards or other fixtures on which brackets and banners are hung, from and against any and all demands, liens, claims and/or suits against Jefferson Parish and/or any other such owner, and their respective agents, servants and employees, related in any way whatsoever to the production, manufacture, installation, presence or removal of the banners or brackets and/or resulting from the content of the banners, whether resulting from the negligence or strict liability of Jefferson Parish and/or of any such owner, their respective agents, servants and employees, agents, servants or employees, including but not limited to damages, costs and expenses, including attorneys' fees, in connection therewith or resulting therefrom. Proof of insurance covering all contractors and subcontractors and other entities or persons involved in the production, manufacture and installation and removal of the banners and brackets, which insurance must name Jefferson Parish and any other owners(s) of the light standards or other fixtures on which brackets and banners are hung, as additional insured(s), must be submitted with the application. The insurance must meet parish requirements and must provide a minimum of one million dollars ($1,000,000.00) in general liability coverage;

    (7)

    The application must specify the portion(s) of approved corridors along which the banners are to be installed;

    (8)

    Written permission from the owner(s) of the light standards or other suitable fixtures must be obtained for the placement or replacement of hardware (on which banners are to be hung) whenever such placement or replacement of hardware is necessary on light standards or other suitable fixtures not owned by the parish.

    (b)

    Review by the carnival and special events division. Review by the carnival and special events division unless the banners are being placed by an entity or entities granted the exclusive right by the Jefferson Parish Council to design, manufacture, install and maintain banners.

    (1)

    Once all of the information and the application required by section 31-65 above have been submitted, the carnival and special events division shall review said application;

    (2)

    The carnival and special events division may require changes and/or additions to the submittals or the design of the banners. Said changes or additions shall be submitted timely in accordance with deadlines to be set by the division;

    (3)

    After review of the initial submittals and any required changes or additions, the division shall submit a report and/or recommendation concerning the proposed banners to the Jefferson Parish Council and to the owner(s) of the light standards or other suitable fixtures on which banners are to be hung which do not belong to the parish;

    (4)

    Sponsors of banners proposed to be hung on light standards or other suitable fixtures which are not owned by Jefferson Parish must obtain the written permission of the owners of said light standards or other suitable fixtures before the submission of the resolution to the Jefferson Parish Council required by section 32-65 for approval of the placement of banners on any public rights-of-way.

    (c)

    Review by council. Review by the council unless the banners are being placed by an entity or entities granted the exclusive right by the Jefferson Parish Council to design, manufacture, install and maintain banners.

    (1)

    The Jefferson Parish Council shall review the application for banners along with the report and/or recommendation of the division, and shall approve or reject said application;

    (2)

    The council may conditionally approve the application. In such an instance, the banners shall not be installed unless the changes, modifications, amendments or conditions approved by the council are met;

    (3)

    The decision of the council shall be the final disposition of the application.

    (d)

    Resolution of sponsorship conflicts.

    (1)

    In the event of conflict between applicants for the same dates and corridors for the placement of banners, the decision of the council shall be final.

    (2)

    The council shall include the following criteria in its consideration in resolving any such conflict:

    a.

    Benefit to Jefferson Parish, especially economic benefit;

    b.

    Benefits to the community at large;

    c.

    Magnitude of the area and number of banners to be placed;

    d.

    Filing dates of the applications, with preference given to the applicants filed earliest; and

    e.

    Quality and originality of the banner artwork.

    (e)

    Review by the director for the department of tourism. Review by the director for the department of tourism when the banners are being placed by an entity or entities granted the exclusive right by the Jefferson Parish Council to design, manufacture, install and maintain banners.

    (1)

    The department of tourism may require changes and/or additions to the submittal or the deign of the banned. Said changes or additions shall be submitted timely in accordance with deadlines to be set by the director of the department of tourism;

    (2)

    After review of the initial submittals and any required changes or additions, the department of tourism shall submit a report and/or recommendation concerning the proposed banners to the Jefferson Parish Council and to the owner(s) of the light standards or other suitable fixtures on which banners are to be hung which do not belong to the parish;

    (3)

    Sponsors of banners proposed to be hung on light standards or other suitable fixtures which are not owned by Jefferson Parish must obtain the written permission of the owners of said light standards or other suitable fixtures before the submission of the report and/or recommendation required above in (2) to the Jefferson Parish Council.
