§ 7-2. Impoundment of livestock.
(a)
The owners of animals impounded shall have the right to the release of such animals only upon the payment of fees as provided for in this section.
(b)
In any case where an animal is not claimed within ten (10) days, it shall be sold at public auction after being advertised three (3) consecutive times in the official journal of the parish. The starting bid for each animal at such public auction shall not be less than the cost to the poundkeeper for the impoundment and keeping of such animal and the cost of the advertisement for three (3) consecutive days in the official journal of the parish as stated above. Any amount bid in excess of such costs shall accrue to the animal shelter department.
(c)
The poundkeeper shall keep a book which includes the following: the description of every animal impounded; the name of owner, if known; the name of purchaser if animal is sold; and any other information in reference to animals impounded. The poundkeeper shall make a detailed report of same to the council.
(d)
The fees, costs and penalties for violation of the provisions of this section payable to the council-appointed poundkeeper shall be as follows:
(1)
For impounding: First offense, one hundred dollars ($100.00) and a written warning; second offense, one hundred twenty-five ($125.00). Upon the occasion of a second offense against an owner within a year, the owner and/or keeper shall be summoned to appear before the Jefferson Parish Administrative Hearing Officer in accordance with section 7-168 for an administrative hearing.
(2)
For keeping: Ten dollars ($10.00) per head for each and every said livestock is kept by the impounder or keeper.
(e)
Nothing in this section shall be construed to conflict with the requirements and provisions of La. R.S. 3:731, et seq., (Brands, Grades, and Inspection), in particular La. R.S. 3:743 (Strayed animals).
