§ 13-128. Failure to control emissions or odors.

  • If it is determined through the use of reliable detection equipment, methods or procedures, including but not limited to olfactometer, photo ionization detectors, flame ionization detectors, infared spectrometers, colormeteric detector tubes or mass spectrometer/gas chromatograph, that a plant has failed to control emissions or odors, the plant shall be subject to actions and/or penalties in accordance with Chapter 1, section 1-10. The plant may also be subject to correctives orders which may include but not be limited to, submission of an odor control plan, installation of odor control equipment, installation of onsite and offsite monitoring equipment, development of onsite and offsite emergency response plans, establishing a plant response team organization, team training, having emergency containment equipment and/or having other engineered mitigation control measures.
