§ 33-1.22. Planning advisory board (PAB).

  • (a)

    Creation . The planning advisory board ("PAB") is hereby established in accordance with Section 4.06 Advisory and Quasi-Judicial Boards of the Jefferson Parish Charter.

    (b)

    Powers and responsibilities.

    (1)

    Powers . In accordance with Section 4.05 Planning of the Charter, the PAB shall have the following powers and it shall be its duty to:

    a.

    Review the comprehensive plan for the social, economic, and physical development of the Parish;

    b.

    Review those ordinances submitted by the planning director, which are designed to effectuate the comprehensive plan for the parish;

    c.

    Review all recommendations of the planning director concerning zoning, subdivision, and other ordinances necessary to ensure the effective application of land-use regulations, and to make recommendations on such proposed changes to the council.

    (2)

    Responsibilities . The PAB shall act in an advisory capacity to the parish council in conformance with the Charter, this Code, and state law. In addition to the powers enumerated in this Code, these responsibilities shall include the following activities:

    a.

    Conduct public hearings and recommend action on the comprehensive plan, changes to the zoning or future land use map, amendments to the text of the zoning code or of this UDC, special permitted use or conditional use permits, major subdivisions, and certain waivers or variances from the Code or this UDC;

    b.

    Make recommendations upon all other items referred to it by the parish council; and

    c.

    File copies of the minutes of its proceedings in the office of the planning director.

    (c)

    Members. The PAB shall consist of seven (7) members.

    (1)

    Appointment . The Jefferson Parish Council, by a majority vote, shall appoint the members with each councilperson appointing one (1) member.

    (2)

    Qualifications . Each PAB member shall:

    a.

    Be a resident of Jefferson Parish;

    b.

    Be a qualified voter of Jefferson Parish; and

    c.

    Own property in Jefferson Parish.

    (3)

    Term length . Each member shall serve a term of four (4) years which shall run concurrently with the term of his/her nominating councilperson.

    (4)

    Vacancy. A vacancy shall be filled by appointment by the councilperson of the district, or division in the case of an at-large council seat, in which the vacancy exists.

    (d)

    Procedures.

    (1)

    Generally. The PAB shall exercise its powers and responsibilities in accordance with article 2, Procedures of this UDC.

    (2)

    Rules of procedure. The PAB shall adopt rules of procedure not in conflict with any state act, parish ordinance, or this UDC.

    (3)

    Quorum and voting. Meetings of the PAB shall take place when a quorum of four (4) members is duly convened. No action of the PAB shall be valid or binding unless adopted by the affirmative vote of four (4) members of the PAB.
